Not Adopted. This memorandum describes interim guidance for implementing the Worker Walkaround Representative Designation Process final rule (“Walkaround rule”), 29 CFR 1903.8(c), which was published on April 1, 2024.
OSH Administration made changes to paragraph D.2 - Employee Participation, in FOM Chapter 3 - Inspection Procedures based on this memorandum. These changes became effective in NC on 10/16/2024.
- Clarified procedures for the CSHO in allowing a "non-employee representative" (refer to paragraph D.2.a.iv.) participate in the walk around: "A non-employee representative may be selected to participate in accordance with 29 CFR 1903.8(c) if, in the judgment of the CSHO, their presence is reasonably necessary to conduct an effective and thorough physical inspection of the workplace. The district supervisor will be consulted prior to allowing a non-employee representative to participate in the inspection."
- Added the portion included in the “Determination of Representative Authorized by Employees” section.
