NCDOL adopted the updated maximum and minimum penalties listed in 29 CFR 1903, and included in this memo, with an enforcement date in NC of July 1, 2025. This memo also outlines OSHA's gravity based penalties and penalty reductions due to size for serious willful violations. These details are addressed in the NC FOM, Chapter 6 - Penalties and, where applicable, have been updated due to the maximum penalty increases (see FOM Ch 6 update effective July 1, 2025). Where the details of gravity based penalties or reductions differ from OSHA's, NCDOL has determined the penalties in NC are at least as effective as OSHA's.
