Not adopted. This April 16, 2024 memorandum provides enforcement guidance regarding potential violations of the Occupational Safety and Health Administration’s (OSHA) rule requiring electronic submittal of injury and illness records, 29 CFR 1904.41(a)(1) and (a)(2).

OSHA's enforcement guidance in this memo regarding potential violations of the rules requiring electronic submittal of injury and illness records was incorporated into the OSH Division's FOM Chapter 6 - Penalties (effective 7/1/2024), along with guidance about other regulatory requirements.  The adoption of this content archives the most recent memo on this topic adopted by OSH - RK 3: Interim Enforcement Procedures for Failure to Submit Electronic Injury and Illness Record, which was published by OSHA on 2/21/2018 and adopted in NC on 3/12/2018. Note: OSHA published another memo on the subject between these two versions on 5/6/2021 - Enforcement Procedures for Failure to Submit Electronic Illness and Injury Records under 29 CFR 1904.41(a)(1) and (a)(2). However, NCDOL was not notified and did not become aware of the memo until 2024.
