Enforcement Exemptions and Limitations under the Annual Appropriations Act

This instruction applies statewide and was originally effective on May 28, 1998 (CPL 02-00-051). The NAICS code appendix is updated annually and contains data generally published by the Bureau of Labor Statistics (BLS) the previous fall, which is based on data from the previous full calendar year. For example, 2023 industry injury/illness data was published by BLS in November 2024. The effective date of Appropriations Act as it relates to the current list of NAICS codes is effective the day after BLS publishes the annual data. 

North Carolina has retained enforcement authority for the Field Sanitation and Temporary Labor Camp Standards in agriculture and therefore, references to the Wage and Hour Division (WHD) will mean the OSH Division/Agricultural Safety and Health Bureau (ASH). See the most recent Memorandum of Understanding between the WHD and ASH for details of this relationship.

The current Low-Hazard Industries list (also linked within CPL) is effective for inspections opened on or after November 8, 2024.

Note: The effective date listed for this document corresponds to the enforcement date of the current low-hazard industries list. The format of this CPL was updated and signed December 13, 2024, but there were no substantive changes to direction provided.
